DUI 0.08% Breath Case -- DISMISSED! Won DMV Hearing

J.S. was pulled over in Alameda County for failing to come to a complete stop at a stop sign. The police officer asked J.S. to perform several Field Sobriety Tests (FSTs), which was done, and then to take a Preliminary Alcohol Screening (PAS) test, which was (lawfully) refused. The officer places J.S. under arrest for DUI, and a subsequent breath test revealed a Blood Alcohol Content (BAC) of 0.08%.
I was able to get the charges dropped and, after winning the Administrative Per Se hearing, J.S. received her driver license back, avoiding a four month suspension.
