DUI for Parking in the Wrong Driveway! 0.20% Blood case. Reduced the Charges; won DMV hearing.
February 2015
M.C. was parked and sitting in his car. Unfortunately it was in someone else's driveway, and police were summoned to the scene. M.C. admitted to consuming some alcohol earlier and agreed to perform several Field Sobriety Tests (FSTs) which, according to the officer's statement, were “performed poorly.” M.C. then blew into a Preliminary Alcohol Screening (PAS) device, which showed a Blood Alcohol Content (BAC) of 0.178%. A subsequent blood test showed M.C.'s blood alcohol level to be 0.20%.
I was able to get the charges reduced to reckless driving, and won the Administrative Per Se hearing, saving my client's driver license.
